Please read these terms carefully before using Streetwise Legal services.
1. Introduction
Welcome to Streetwise Legal ("we", "us", "our"). These Terms and Conditions ("Terms") govern your use of our legal roadblock assistance services, mobile application, and website (collectively, the "Services").
By registering for, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.
2. Definitions
- "Member" means an individual who has registered and paid for a Streetwise Legal membership.
- "Membership" means the subscription service providing access to legal roadblock assistance.
- "Emergency Hotline" means our 24/7 telephone support service for roadblock incidents.
- "Roadblock" means any lawful vehicle checkpoint conducted by South African law enforcement or traffic authorities.
- "Legal Assistance" means advice and guidance provided by our legal professionals regarding roadblock-related matters.
3. Membership and Registration
3.1 Eligibility
To become a Member, you must:
- Be at least 18 years of age
- Be a resident of South Africa
- Hold a valid South African driver's license
- Provide accurate and complete registration information
- Pay the applicable membership fees
3.2 Membership Fees
Membership requires payment of:
- A one-time registration fee of R100.00
- A monthly subscription fee of R99.00, billed on the same day each month
The initial payment of R199.00 covers both the registration fee and the first month's subscription. All fees are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.
3.3 Automatic Renewal
Your membership will automatically renew each month on the billing date unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method for the monthly subscription fee.
4. Services Provided
4.1 24/7 Emergency Hotline
Members have access to our emergency hotline for immediate legal guidance during roadblock situations. Our team will provide real-time advice on your rights and obligations.
4.2 Legal Guidance
We provide information and guidance on:
- Your rights during a roadblock stop
- Proper procedures for vehicle searches
- Documentation requirements
- How to handle specific roadblock scenarios
- Referrals to attorneys when necessary
4.3 Digital Membership Card
Members receive a digital membership card accessible through our mobile application, providing proof of membership and quick access to emergency contact information.
4.4 Incident Reporting
Members can report and document roadblock incidents through our application, creating a record for future reference or legal proceedings.
5. Service Limitations
Important Notice
Streetwise Legal provides legal information and guidance only. We do NOT provide legal representation, appear in court on your behalf, or guarantee any specific legal outcomes.
5.1 Information Only
Our Services provide general legal information and guidance. This does not constitute formal legal advice or create an attorney-client relationship.
5.2 No Guarantees
We cannot guarantee specific outcomes in roadblock situations. Legal matters depend on many factors beyond our control, including the specific circumstances, applicable laws, and decisions made by law enforcement or courts.
5.3 Geographic Limitation
Our Services are designed for roadblock situations within the Republic of South Africa and are based on South African law. We cannot provide guidance for incidents in other countries.
6. Member Obligations
As a Member, you agree to:
- Provide accurate and complete information during registration
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Comply with all applicable South African laws and regulations
- Use the Services only for lawful purposes
- Not abuse or misuse our emergency hotline service
- Update your contact information if it changes
- Pay all fees when due
- Follow the guidance of law enforcement officers during roadblock stops
7. Payment and Billing
7.1 Payment Methods
We accept payment through Paygate and Ozow payment gateways. By providing payment information, you authorize us to charge your chosen payment method. For recurring subscriptions via Paygate, your card details are securely tokenized for automatic renewals. You may cancel your subscription at any time through your account settings.
7.2 Failed Payments
If a monthly payment fails, we will attempt to process payment again. If payment cannot be collected within 7 days of the due date, your membership may be suspended or cancelled.
7.3 Refund Policy
The registration fee (R100) is non-refundable. Monthly subscription fees are non-refundable once charged, except in cases of:
- Billing errors by Streetwise Legal
- Service unavailability for more than 48 consecutive hours
- Duplicate charges
Refund requests must be submitted within 14 days of the charge.
8. Cancellation
8.1 Cancellation by Member
You may cancel your membership at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current billing period.
Important: Complete Cancellation Process
To ensure your subscription is fully cancelled and no further payments are processed, you MUST complete BOTH steps:
Go to your Account Settings and click "Cancel Subscription" to cancel your membership. Cancellation takes effect at the end of your current billing period. No further payments will be processed after cancellation.
8.2 Cancellation by Streetwise Legal
We reserve the right to suspend or terminate your membership if you:
- Violate these Terms and Conditions
- Provide false or misleading information
- Abuse our Services or emergency hotline
- Fail to pay fees when due
- Engage in fraudulent activity
9. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA).
By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.
10. Limitation of Liability
To the maximum extent permitted by South African law:
- Streetwise Legal provides Services "as is" without warranties of any kind
- We are not liable for any outcomes of roadblock incidents
- We are not responsible for actions taken by law enforcement officers
- Our total liability shall not exceed the fees you paid in the 12 months preceding any claim
- We are not liable for indirect, consequential, or punitive damages
This limitation applies regardless of the legal theory of the claim, whether in contract, tort, or otherwise.
11. Indemnification
You agree to indemnify and hold harmless Streetwise Legal, its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of our Services
- Your violation of these Terms
- Your violation of any law or the rights of third parties
- Any false or misleading information you provide
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Email to your registered email address
- Notice within our mobile application
- Updating the "Last Updated" date at the top of this page
Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of South Africa.
14. Dispute Resolution
In the event of any dispute arising from these Terms or your use of our Services:
- You agree to first contact us to attempt to resolve the matter informally
- If informal resolution fails, the dispute may be referred to mediation
- Only if mediation fails may either party institute legal proceedings

16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Streetwise Legal regarding your use of our Services and supersede all prior agreements and understandings.
By using Streetwise Legal Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
